Article 1 — Purpose
These Terms of Service (hereinafter "ToS") govern access to and use of the prompterie.com website (hereinafter the "Platform"), operated by La Prompterie.
The Platform is a marketplace for buying and selling prompts for artificial intelligence tools. Any use of the Platform implies full and unreserved acceptance of these ToS.
Article 2 — Definitions
- Platform: the prompterie.com website and all its functionalities.
- User: any natural or legal person accessing the Platform, whether registered or not.
- Member: a User who has created an account on the Platform.
- Buyer: a Member purchasing one or more Prompts.
- Seller (or Creator): a Member who has activated the seller status and publishes Prompts for sale.
- Prompt: an instruction text intended to be used with an artificial intelligence tool to produce a specified result.
Article 3 — Access to the Platform
Access to the Platform is open to anyone with an internet connection. Browsing the Prompt catalogue is free of charge.
Purchasing Prompts, publishing Prompts and accessing member features (reviews, favourites, history) require an account.
Article 4 — Registration
4.1 Account creation
Registration is free and open to any adult natural person or legal entity. The User provides a valid email address and chooses a password that meets the Platform's security requirements.
Registration may also be completed via a third-party authentication service (Google, GitHub or Apple). In that case, the information provided by the third-party service stands as registration data.
4.2 Single account
Each natural person or legal entity may hold only one account. The creation of multiple accounts is prohibited and may result in the suspension or deletion of all affected accounts, without notice or compensation.
4.3 Responsibility
The User is solely responsible for the confidentiality of their login credentials and for any activity performed from their account.
Article 5 — Seller status
5.1 Activation
Any Member may request activation of the Seller status from their personal area. Activation is subject to acceptance of the Terms applicable to Sellers and completion of an identity verification and bank registration procedure, carried out by the Platform's payment provider.
5.2 Identity verification
Identity verification is performed by the payment provider in accordance with applicable anti-money-laundering and counter-terrorism-financing regulations ("Know Your Customer"). The Platform does not carry out this verification itself and does not store any identity documents.
5.3 Seller obligations
The Seller undertakes to publish original Prompts consistent with their description and not in breach of any applicable law. The Seller refrains from publishing any illegal, hateful, discriminatory, pornographic content or content infringing third-party intellectual property rights.
Article 6 — Intellectual property
6.1 Platform content
All elements constituting the Platform (design, code, texts, logo, brand, graphic charter) are the exclusive property of La Prompterie and are protected by applicable intellectual property laws.
6.2 Prompts published by Sellers
The Seller retains full intellectual property rights over the Prompts they publish. By publishing a Prompt, the Seller grants the Platform a non-exclusive, worldwide licence for the duration of publication, authorising the Platform to display, commercialise and promote the Prompt.
6.3 Licence granted to the Buyer
The Buyer acquires a personal, non-exclusive and non-transferable licence to use the purchased Prompt. The Buyer must not redistribute, resell, share or publish the full text of the Prompt on any medium.
Article 7 — User conduct
Every User of the Platform undertakes to:
- Not attempt unauthorised access to any content, account or system of the Platform.
- Not use bots, scripts or any automated means to extract data from the Platform.
- Not post false reviews or abusive reports.
- Respect the intellectual property rights of Sellers and the Platform.
- Not bypass, alter or remove protection measures applied to Prompts.
Article 8 — Account deletion
8.1 By the User
Any Member may request the deletion of their account from their personal area. Deletion is final and irreversible.
When a Buyer account is deleted, access to all purchased Prompts is permanently lost.
When a Seller account is deleted, the published Prompts remain accessible to existing Buyers and remain on sale on the Platform in accordance with the Terms applicable to Sellers.
8.2 By the Platform
The Platform reserves the right to suspend or delete any account in the event of a breach of these ToS, proven or suspected fraud, or at the request of a competent judicial or administrative authority.
Article 9 — Reporting
Any Buyer may report a Prompt they consider non-compliant with its description, inappropriate or infringing. Reports are handled by the Platform's moderation team. The Platform reserves the right to remove any Prompt subject to founded reports, without notice or compensation to the Seller.
Article 10 — Limitation of liability
The Platform acts as a technical intermediary between Sellers and Buyers. As such:
- The Platform does not guarantee the results obtained from using Prompts, which depend on the AI models used and their parameters.
- The Platform is not responsible for the content published by Sellers.
- The Platform does not guarantee continuous, uninterrupted availability of the service.
- The Platform disclaims any liability for indirect damage arising from the use or inability to use the service.
Article 11 — Changes to the ToS
The Platform reserves the right to amend these ToS at any time. Members will be informed of any substantial change by email or by notification on the Platform. Continued use of the Platform after the change constitutes acceptance of the new ToS.
Article 12 — Applicable law
These ToS are governed by Swiss law. In the event of a dispute, the parties will first endeavour to reach an amicable solution through direct exchange before any judicial action.
